How much did litigation cost your company last year? Most people answer by adding up legal fees and court costs. That is the visible part. The invisible part is usually larger.
Costs that stay off the spreadsheet
- Management time: meetings, document searches, attending hearings.
- Cash frozen by a court-ordered account freeze.
- Settlements reached in a rush, without knowing the real risk.
- Expert reports, court errands and judgments that keep repeating for the same reason.
Where the cost comes from
Much of it starts before the lawsuit: a loosely drafted contract, an HR routine without records, collections without a strategy. Looking at one case at a time hides the pattern. Looking at the whole portfolio shows where the cost is and where it originates.
Litigation mapping
A survey of all the company's cases, civil, labour, tax and administrative: what is pending, how much it may cost, where the real risk lies and where it is worth negotiating, appealing or closing. The company sees its entire exposure.
Preventive mapping
A review of contracts, labour routines, documents and internal practices to identify where the next claims will come from and fix the cause before it becomes a lawsuit. In labour judgments, for example, mapping shows which claims recur and which internal practice triggers them.
How the work is usually organised
- Pre-diagnosis: understanding the company and setting objectives.
- Fact-finding and analysis, with the people who run the routine.
- Report with the risks found and recommendations.
- Implementation with a timeline and follow-up.
- Final report with the changes made and their impact.
One simple question helps you start: do you know how many lawsuits your company has pending today? Every company is different, and any diagnosis depends on an analysis of the specific case.
